Provision 5.4: Taxes & IRS Rules:
The WINNER of any Raffle PRIZE shall be responsible for any and all federal, state and local income or excise taxes, fees, and assessments and like charges due associated with the winning of such a PRIZE.
The IRS requires that income tax withholding on PRIZE values of $5,000.00 or greater must be paid before distribution is made to the WINNER. Cash PRIZEs will be paid to the WINNER net applicable income tax withholding.
All WINNERs, during the completion of the Verification of Identity Form, NPOFSForm 11, will be required to provide a Social Security Number. This requirement enables NPOFS to prepare and submit the IRS required forms documenting the issuance of the PRIZE to the WINNER. This information will only be retained for as long as required by the IRS. It will be stored in a secure manner in order to restrict access to it and to protect it. See the CR.org Privacy Policy for additional information.
Special Tax Note: Government rules governing withholdings can change without notice, and NPOFS will follow the rules and laws in effect at the time the PRIZEs are awarded. The IRS has taken the position that donations to charities that involve a raffle are not gifts and, therefore, the donation does not qualify as a deductible charitable contribution. Based on current IRS tax rules, the minimum withholding tax rate for prizes is 28%. Check with your qualified financial advisor for additional information.
